Terms and Conditions

INTRODUCTION

These Terms and Conditions hereinafter referred to as the "Agreement" , sets out the guidelines, regulations, restrictions, limitations, obligations, and responsibilities of our employees, agents, contractors, or other individuals ("you", "your") using any of website, mobile browser site, instore application, and other digital publishing services owned or operated by Plainview Knights Basketball Association, ("Company", "us", "we", "our").  All services herein will be referred to as "Services".

ACCEPTANCE AND AGREEMENT

By sponsoring the Event, you agree to be under the Terms and Conditions contained in this Agreement and the responsibilities and obligations that come with it.  If you do not agree with any of the stipulations stated herein, kindly immediately reach out to us so that we can address your concerns.  This agreement applies to you and us for the services we provide for you ("Agreement") and any donation you will make to us ("Donation").  By booking our Services or by making a donation.  You agree to be bound by the terms and conditions specified in this  ("Agreement").  You should print a copy of this document for future reference.

TERMS

1.  SCOPE

This ("Agreement") applies to you and us for the ("Services") we provide for you ("Contract") and any donation you will make to us ("Donation").  We encourage you to read the provisions set forth in this ("Agreement") carefully and make sure that you fully understand  them before accessing  of any of our services or making a ("Donation").  By booking our ("Services") or making a ("Donation"), you agree to be bound by these terms and conditions specified in the ("Agreement") for such services.  You should print a copy of this document for future reference.

REGISTRATION, ACCESS AND USE

We allow users to be part of our digital platforms through procedural registration.  We list below registration services that may be changed from time to time in the future.  Our users will be notified about the changes in the registration process and appended to the terms and conditions page and communicated via email.

For individual subscribers, we offer our registration services.  If more than one individual decides to register to access the same account or for another corporate account, please do not hesitate to contact us through email or a call.  Take note that subscription rates, if any, vary depending on the available access package.

The type and volume of ("Services") you get on our digital platforms will be based on the type of Sponsor Tier you choose, your geographical location, the offer you subscribe to, or the searches detected by our algorithm.  The following are the types of sponsor tiers you can choose from:

Donations.

More details about these ("Services") can be found on our website, or email info@plainviewknights.com.  We may in exceptional circumstances, cease to provide some  sponsor tiers.  We will give you at least seven working days notice regarding the non-fulfillment of your sponsorships.  When this has been processed and fulfilled, we will have no further obligation to you.

2.  JOINT CONTENT SUBSCRIPTION

When you participate and choose to subscribe to joint content subscription offers that we partner with, your email identification, access password, and entered personal information will be shared with the participating content partner brand via an encrypted server to server protocol.  This sharing is to facilitate your seamless access across the partner and/or affiliate brand's platform.  Once you log in to the partner and/or affiliate brand's platform, specific terms and privacy policies of the partner and/or affiliate brand will apply.

3.  PERSONAL CONTENT SUBSCRIPTION

By registering for a personal subscription, you will have access to behind the pay wall content.  When you subscribe to our premium access, "Members Only Area" you gain access to opinion content, comments, discounts, and exclusive features specially curated by us for you.  The nature of content behind the paywall is subject to change from time to time, and the editor decides what content to post periodically.

4.  TERMINATION AND RENEWAL 

If you have a premium subscription, then you may terminate your subscription in writing.  Sponsorships and/or banner rotation must either be renewed or canceled before next billing period in writing.  If said sponsorship is not renewed, it will terminate.  If said banner rotation is not renewed, it will terminate.  Although you might opt to renew your subscription.

5.  LOSS OF DAMAGE

We will be responsible for the loss or damage you suffer which is the reasonably foreseeable result of our breach of a legal duty of care owed to you.  We will not be responsible or have any responsibility for any loss or damage suffered by your business, such as lost data, loss profits, or any business interruption.

6.  LIABILITY AND INDEMNIFICATION

You agree that if your breach any of the provisions in this ("Agreement"), we will only be responsible to you for any damages that you incur arising out of your use of our platforms.  If you incur any loss as a result of using any of our content outside the scope of provisions herein, we will no longer have any responsibility (liability) to you.  You will be responsible for all claims, liabilities, damages, costs and expenses suffered or incurred as a result of the material breach you committed.

7.  INTELLECTUAL  PROPERTY

All content created and published on the digital platforms, including our mobile browser site, applications, electronic files, artwork concepts, and E paper belongs to Plainview Knights Basketball Association, and our licensor, who own all intellectual property rights (including copywrite and database rights).  No intellectual  property rights in any form of the content are transferred to you while you use the content on these platforms, or our content not on this platform.

8.  TRADEMARKS

Any Trademark registered under our business may not be used by you without prior written permission from Plainview Knights Basketball Association.  All rights reserved to the Plainview Knights Basketball .  You are not permitted to use the content on this platform , the logos and likeness for personal use or gain. Yo may only browse the content as it pertains to the Plainview Knights website as set out in our Copywrite policy.

9.  TRANSFER OF RIGHTS

You may not license or transfer any of your rights under these Terms and Conditions.  We may transfer any of our rights or obligations under these terms and conditions to any individual, entity, organizations, but if we do so, we will ensure that any individual, company or entity to whom we transfer our rights or obligations will continue to honor your rights under them.  Any resultant changes to the terms and conditions will be sent to you via email and updated on our website.

10.  SEVERABILITY

If any provision of these terms and conditions are found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of  the remaining provision of these terms and conditions, which will remain in full force.

11.  REMEDY

Failure by either party to exercise any right  or remedy under  this ("Agreement") does not constitute a waiver of that right or remedy.  Headings in the ("Agreement") are for convenience only and will have no legal meaning or rights.

12.  LAW AND JURISDICTION

Plainview Knights Basketball Association, understands that we cater to users from all over the world.  In this case,  wherever a user is, his or hers usage of our Services will be subject  to the laws and regulations of the United States.  To the extent possible in the applicable jurisdiction, you agree that competent Courts of the United States, will have non-exclusive jurisdiction over any disputes arising out of or in connection with your registered usage of any of our ("Services).

13.  CHANGE TO TERMS

This ("Agreement"), and the terms and conditions herein, was published in May 2022.  It was updated on September 6, 2022, and immediately replaced the Terms and Conditions previously published.

14.  RETURN/REFUND POLICY

The Plainview Knights will accept returns if after purchase there is a manufacturer's defect within 7 days.  You are responsible for the return payment and shipment back to our office.  You will receive a store credit for another product of the same value or more.  We will not refund monetary funds on products.

The Plainview Knights will refund monetary funds on certain merchandise or services purchased (excluding) any level of ("Sponsorships") since the professional monies are already in usage.  If a refund is granted, the processing fee paid by the Plainview Knights from the payment processor company will be deducted, and a $5 inconvenience fee, before said refund is processed.
